Terms of User Agreement

By using the Platform, you acknowledge that you have read, understood, and accepted this Agreement in its entirety. This Agreement constitutes a legally binding contract between you and PakMedics. We reserve the right to update or modify these terms at any time without prior notice. Your continued use of the Platform following any changes constitutes your acceptance of the revised terms.

• You must be at least 18 years of age to register for an account or use the Platform.
• You agree to provide accurate, current, and complete information during registration and to update such information promptly.
• You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You agree to notify us immediately of any unauthorized use of your account or any other security breach.

• Patients: You agree to provide truthful and complete health information to healthcare professionals. You acknowledge that telehealth services have limitations and that in-person care may be recommended when necessary.
• Healthcare Professionals: You represent and warrant that you hold all necessary licenses, certifications, and insurances to practice in your jurisdiction. You are solely responsible for the quality, accuracy, and legality of the care you provide through the Platform.
• General Users: You agree to use the Platform for lawful purposes only and in a manner that does not infringe on the rights of others.

You agree not to:

• Use the Platform for any unlawful, fraudulent, or malicious purpose.
• Upload, post, or transmit any content that is defamatory, obscene, offensive, or invasive of another's privacy.
• Attempt to interfere with or disrupt the Platform's infrastructure or security systems.
• Impersonate any person or entity or misrepresent your affiliation with any organization.
• Engage in data mining, scraping, or automated access without our prior written consent.

• Patients engaging with healthcare professionals through the Platform consent to the delivery of telehealth services, including the use of electronic communications, video conferencing, and digital health records.
• You understand that telehealth is not a substitute for in-person emergency care. In case of a medical emergency, please contact your local emergency services immediately.
• Healthcare professionals are responsible for obtaining informed consent from patients before providing any services.

• All content on the Platform, including text, graphics, logos, icons, images, audio, video, and software, is the exclusive property of PakMedics or its licensors and is protected by copyright, trademark, and other intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes.
• You may not reproduce, distribute, modify, or create derivative works from any Platform content without our express written permission.

• By submitting content (including reviews, feedback, or comments) to the Platform, you grant PakMedics a worldwide, royalty-free, perpetual, and irrevocable license to use, display, reproduce, and distribute such content in connection with the Platform.
• You represent and warrant that you own or have the necessary rights to any content you submit and that such content does not violate any laws or third-party rights.
• We reserve the right to remove or moderate any user-generated content at our sole discretion.

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Platform, you consent to the collection and use of your data as described in our Privacy Policy. We comply with applicable data protection laws, including the Pakistan Personal Data Protection Act and relevant international standards.

• Certain Services may require payment of fees, which will be clearly disclosed before you complete a transaction.
• All payments are processed through secure third-party payment gateways. PakMedics does not store your payment card details.
• Fees are non-refundable unless otherwise stated or required by applicable law.
• Healthcare professionals are solely responsible for setting their own consultation fees and collecting payments through the Platform.

• Patients may cancel appointments in accordance with the cancellation policy disclosed by the healthcare professional.
• Refunds, if any, are subject to the individual professional's refund policy and applicable consumer protection laws.
• PakMedics is not responsible for disputes between patients and healthcare professionals regarding cancellations or refunds.

We reserve the right to suspend or terminate your account at any time, without prior notice, for any reason, including but not limited to:

• Violation of this Agreement or any applicable laws.
• Fraudulent, abusive, or unlawful conduct.
• Non-payment of fees or other charges.

Upon termination, your right to access the Platform ceases immediately, and we may delete your account and associated data in accordance with our Privacy Policy.

• The Platform and Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
• We do not warrant that the Platform will be uninterrupted, error-free, or secure at all times.
• We do not endorse or guarantee the accuracy, completeness, or reliability of any content or advice provided by healthcare professionals on the Platform.
• Any reliance on information obtained through the Platform is at your own risk.

To the fullest extent permitted by law, PakMedics and its affiliates, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with:

• Your use or inability to use the Platform.
• Any content, advice, or services provided through the Platform.
• Unauthorized access to or alteration of your transmissions or data.
• Any other matter relating to the Platform.

This limitation applies regardless of the theory of liability, including breach of contract, tort (including negligence), or otherwise.

You agree to indemnify, defend, and hold harmless PakMedics and its affiliates, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:

• Your violation of this Agreement.
• Your use of the Platform.
• Your violation of any laws or third-party rights.
• Any content you submit through the Platform.

• This Agreement shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan.
• Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Islamabad, Pakistan.
• Prior to initiating legal proceedings, the parties agree to attempt good-faith negotiations to resolve the dispute amicably.

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be interpreted to reflect the original intent of the parties as closely as possible.

This Agreement, together with our Privacy Policy and Disclaimer, constitutes the entire agreement between you and PakMedics regarding your use of the Platform and supersedes all prior or contemporaneous understandings, whether written or oral.
