1. Introduction & Acceptance
Welcome to PAK Medics ("Platform," "we," "us," or "our"). These Terms of Service ("Terms," "Agreement") govern your access to and use of the PAK Medics website (pakmedics.com), the PAK MedicalCare patient portal (pakmedicalcare.com), any associated white-label websites provided to healthcare providers, our mobile applications, and all related services (collectively, the "Services").
➡By registering for an account, clicking "I Agree," or otherwise accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Services.
➡These Terms constitute a legally binding agreement between you (the "User") and PAK Medics (PMC). If you are using the Services on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.
2. Definitions
➡"Content" means text, graphics, images, music, software, audio, video, information, and other materials.
➡"Escrow Wallet" means the managed digital payment holding account provided as part of the Services.
➡"Healthcare Provider" or "Provider" means a licensed medical professional (e.g., doctor, dentist, therapist, homeopath, hakeem) or a healthcare business (e.g., clinic, diagnostic lab, pharmacy, home care agency) that uses the Services to offer services to Patients.
➡"Patient" means an individual who uses the Services to search for, book appointments with, consult, or make payments to Healthcare Providers.
➡"Patient Data" or "Protected Health Information (PHI)" means any information about a Patient's health, treatment, or payment that is created, received, or maintained by a Provider through the Services.
➡"Platform Content" means all Content we make available through the Services, excluding User Content.
➡"Services" means all websites, applications, and functionalities provided by PAK Medics.
➡"User" means any individual or entity using the Services, including both Providers and Patients.
➡"User Content" means all Content a User submits, posts, uploads, or transmits through the Services (e.g., medical records, profile information, reviews, messages).
3. Description of Services PAK Medics provides a technology platform that facilitates connections between Patients and Healthcare Providers. Our Services include, but are not limited to:
➡A SaaS platform for Providers to manage appointments, patient records, telemedicine, and billing.
➡A public directory and booking platform for Patients.
➡White-label website hosting for Providers.
➡A secure Escrow Wallet for processing payments.
➡Tools for Providers to sell courses (MentorInn.com) or products (PakMade.com).
CRITICAL UNDERSTANDING: PAK MEDICS IS A TECHNOLOGY PLATFORM, NOT A HEALTHCARE PROVIDER. WE DO NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. ANY CONSULTATION OR INTERACTION BETWEEN A PATIENT AND A HEALTHCARE PROVIDER IS STRICTLY BETWEEN THEM. WE ARE NOT A PARTY TO ANY AGREEMENT BETWEEN A PATIENT AND A PROVIDER.
4. Account Registration & Eligibility To use certain Services, you must register for an account.
➡You must be at least 18 years old.
➡You must provide accurate, current, and complete information.
➡You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
For Healthcare Providers: You represent and warrant that you hold all necessary active licenses, certifications, and professional qualifications required by Pakistani law to practice your profession. You agree to verify your credentials as requested.
For Patients: You represent and warrant that all information you provide, including medical history, is accurate and complete to the best of your knowledge.
5. Financial Terms & Escrow Wallet
➡Provider Fees: Access to certain Services requires payment of subscription fees as described on our Pricing page. Fees are non-refundable except as required by law.
➡Escrow Wallet: We provide a payment facilitation service. Payments from Patients for Provider services are held in a secure Escrow Wallet until the service is completed, after which funds are released to the Provider per our payout schedule, minus any applicable platform transaction fees.
➡No Banking Services: The Escrow Wallet is a payment processing tool. It is not a bank account, and funds are not insured by any deposit guarantee scheme.
➡Taxes: You are solely responsible for any taxes applicable to your use of the Services.
6. User Responsibilities & Acceptable Use
➡You agree NOT to use the Services to:
➡Violate any applicable local, national, or international law.
➡Impersonate any person or entity or misrepresent your affiliation.
➡Engage in fraudulent, deceptive, or harmful activities.
➡Upload or transmit viruses or malicious code.
➡Attempt to gain unauthorized access to any part of the Services.
➡Infringe upon the intellectual property rights of others.
For Providers: Prescribe medication or treatment without a valid license or patient relationship.
For Patients: Submit false medical information or book appointments under false pretenses.
7. Intellectual Property Rights
➡Our Rights: The Services, Platform Content, and our underlying technology are protected by copyright, trademark, and other laws. You may not copy, modify, or create derivative works without our express permission.
➡Your Content: You retain ownership of your User Content. By submitting User Content, you grant PAK Medics a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and display such Content solely for the purpose of operating, promoting, and improving the Services (e.g., displaying your clinic profile on your white-label site and the main directory).
8. Privacy & Data Security
➡Your privacy is paramount. Our collection, use, and protection of your personal data and Patient Data are governed by our Privacy Policy, which is incorporated into these Terms. By using the Services, you consent to our data practices as described in the Privacy Policy.
9. Termination & Suspension
➡We may suspend or terminate your access to the Services immediately, without prior notice, if we believe you have violated these Terms. You may terminate your account at any time. Upon termination, your right to use the Services ceases immediately.
10. Disclaimer of Warranties & Limitation of Liability
DISCLAIMER: THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, PAK MEDICS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
NO MEDICAL LIABILITY: PAK MEDICS IS NOT RESPONSIBLE FOR ANY HEALTHCARE OR RELATED SERVICES PROVIDED BY HEALTHCARE PROVIDERS. WE DO NOT ENDORSE, WARRANT, OR GUARANTEE THE QUALITY, ACCURACY, OR COMPLETENESS OF ANY MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT PROVIDED VIA THE PLATFORM.
LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAK MEDICS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM
(A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES;
(B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES.
OUR TOTAL AGGREGATE LIABILITY SHALL BE LIMITED TO THE AMOUNT YOU HAVE PAID US IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.
11. Indemnification
➡You agree to defend, indemnify, and hold harmless PAK Medics, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt (including reasonable attorney's fees) arising from:
(a) your use of and access to the Services;
(b) your violation of any term of these Terms;
(c) your violation of any third-party right, including any intellectual property or privacy right; or
(d) any claim that your User Content caused damage to a third party.
12. Governing Law & Dispute Resolution
➡This Agreement shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict of law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in [Islamabad, Pakistan].
13. Miscellaneous
➡Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and PAK Medics.
Changes: We may modify these Terms at any time. We will provide notice of material changes. Your continued use of the Services after such notice constitutes your acceptance of the new Terms.
Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
